Висвітлюється питання оспорювання рішень міжнародного комерційного арбітражу. Так, інститут оспорювання та, звідси, скасування арбітражного рішення частково врегульовано Європейською конвенцією 1961 р. та Нью-Йоркською Конвенцією 1958 р. Метою оспорювання або перевірки арбітражних рішень у місці його винесення є недопущення визнання і приведення до виконання арбітражних рішень, які були винесені з суттєвими порушеннями, перш за все процесуального характеру. Результатом проведення оспорювання може статискасування (повністю або частково) такого арбітражного рішення судом у місці, де воно було винесене, що в свою чергу тягне за собою зазвичай неможливість його визнання і приведення до виконання. У механізмі правового регулювання мка скасування арбітражного рішення - інститут внутрішнього права кожної окремої країни. Арбітражне рішення може бути скасоване тільки державним судом країни-місця ухвалення арбітражного рішення чи державним судом країни, за законодавством якої арбітражне рішення було ухвалено.Перелік підстав для скасування арбітражного рішення визначається законодавством країни суду, в якому розглядається справа про скасування арбітражного рішення. Цей перелік є вичерпним. Крім того в статті дається аналіз судової практики щодо підстав ск&асування рішення міжнародного комерційного арбітражу, яка дозволяє зробити висновки про певну недосконалість чинного процесуального законодавства, яке потребує подальшому вдосконаленню.
The appeal of the international commercial arbitration awards i&s a major issue in the dispute settlement mechanism for arbitration governed by multilateral conventions, bilateral treaties and national laws, as well as by the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards of 195&8. Notwithstanding the importance of the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards of 1958, it restricts to a certain extent the scope of legal protection of arbitral awards, as it leaves national courts to cha&llenge them by the way of possible annulment, and national courts when considering petitions for annulment decisions are vested in the power to revoke such decisions. In this respect, the resolution of these issues may raise the issue of the correlat&ion between the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards 1958 and domestic legislation of the countries in which the relevant decision may be challenged. The specific of the international commercial arbitratio&n decision is that it cannot be appealed to any higher court. However, the absence of any form of control over the arbitral award could lead to the enforcement of such decisions, which, if rendered within the judicial system, would be overturned or m&odified by a higher court. Therefore, there is an institution for challenging arbitral awards in national courts. Due to the fact that the arbitration award is a form of control by national courts, the regulation of this institution is defined in the& legislation of each individual country, and at the international legal level only certain aspects are regulated. These are the European Convention of 1961 and the New York Convention of 1958.
