На підставі аналізу окремих історичних пам"яток законодавства досліджуються питання генезису інституту дізнання. Розглянуто останні зміни та доповнення до чинного кримінального процесуального законодавства України, що регламентують досліджувану форму досудового розслідування. Виділено окремі аспекти щодо сутності та процедури здійснення дізнання в деяких країнах Європейської спільноти, які уявляються перспективними для вітчизняного законодавця.
На основании анализа отдельных исторических памятников законодательства исследуются вопросы генезиса института дознания. Рассмотрены последние изменения и дополнения в действующее уголовное процессуальное законодательство Украины, регламентирующее исследуемую форму досудебного расследования. Выделены отдельныеаспекты относительно сущности и процедуры осуществления дознания в некоторых странах Европейского сообщества, которые представляются перспективными для отечественного законодателя.
The reform of criminal procedural legislation conducted within the framework of the general legal and judicial reform, when the Criminal Procedural Code of Ukraine entered into legal force in 2012, proved to be imperfect and incomplete. More than fifty laws were adopted during this time, however, numerous changes in the &legal regulation of criminal proceedings as a rule of thumb states, do not ensure the steady implementation of the tasks of the criminal procedure so far. The above mentioned fully refers to the issues of pre-trial investigation of misdemeanors in th&e form of inquiry. The current state of the development of domestic criminal procedure is characterized by the existence of fundamental changes in the legislation that take place in the field of legal regulation of all stages and forms of criminal ju&stice, including inquiry. Based on the analysis of certain historical sources of the legislation, we can argue that the researched form of pre-trial investigation radically changed its essence and significance with the adoption of every new criminal &and procedural law, since the legislator called different activities by the same term. Thus, both procedural activity regulated by the norms of the criminal procedure and the activities carried out by operative and search measures, were in particular& understood as inquiry. Comparative and legal analysis of the legislation on the researched issue of some European countries allows to state that there is an obvious tendency to optimize the pre-trial investigation by its simplifying. Such an approac&h is not surprising as it fits into the general integration process of the development of the legislation, which is directly reflected in international and legal acts, for example, in the Recommendation of the Council of Europe Committee of Ministers& No. 6 R (87) "On the Simplification of Criminal Justice". It should be noted that, unlike the European model, the inquiry of most post-Soviet countries begins with the issuance of a ruling on the prosecution, with the exception of Georgia, Kazakhsta&n and Ukraine, and is exclusively carried out by procedural methods. At the same time, the assessment of the effectiveness of the domestic inquiry institution should be solely carried out through the practical component, which is currently absent.t.
