Стаття присвячена висвітленню проблемних аспектів правового закріплення юрисдикційних повноважень незалежного органу державного регулювання у сфері енергетики - Національної комісії, що здійснює державне регулювання у сфері енергетики та комунальних послуг. На підставі аналізу законодавства України та позицій науковців автором зроблено ряд висновків та сформульовано пропозиції щодо удосконалення законодавства України у цій сфері.
Статья посвящена освещению проблемных аспектов правового закрепления юрисдикционных полномочий независимого органа государственного регулирования в сфере энергетики в Украине - Национальной комиссии, осуществляющей государственное регулирование в сфере энергетики и коммунальных услуг. На основании анализа законодательства Украины и позиций ученых автором сделан ряд выводов и сформулированы предложения по усовершенствованию законодательства Украины в данной сфере.
The article explores the issues of legal regulation of sanctioning powers of the energy regulatory authority inUkraine - the National Energy and Utilities Regulatory Commission. The constitutional and administrative reforms are taking place in Ukraine. The enhancement of the legal status of independent regulatory authorities in certain fields of economy is am&ong key objectives needed to be performed by the scholars and practitioners. The Draft Law on National Energy and Utilities Regulatory Commission is under consideration by the Verkhovna Rada of Ukraine. Therefore it is important to develop the theore&tically proven recommendations on the enhancement of its legal status with consideration of the EU requirements and EU Member States experience. The sanctioning powers can be defined as traditional powers of independent regulatory authorities in the ®ulated industries, in particular, in energy sector. The energy regulator in Ukraine is empowered by such powers. However its legal regulation needs to be improved. Also it should be considered the necessity of the enhancement of the institute of a&dministrative liability in Ukraine in general. Considering mentioned above the proposed article aims to analyze the legislation of Ukraine related to sanctioning powers of energy regulator and to develop the recommendations on its enhancement. Based &on the analysis conducted it is concluded that there is no consistency in legal regulation of sanctioning powers of the energy regulatory authority in Ukraine. Considering the peculiarities of the legal status of the energy regulatory authority as an& independent regulatory authority in energy sector, as well as scientific approaches to the enhancement of the institute of administrative liability in Ukraine it is suggested to define the general framework of the administrative liability in the con&ceptual codified legal act, general sanctioning powers of the regulatory authorities in certain fields of economy - in the law on national regulatory commissions suggested by the author of this publication, and concrete administrative delicts, admini&strative sanctions and peculiarities of the sanctioning powers of the energy regulator - in special legal acts that regulate relations in certain fields of economy.
