Статтю присвячено огляду формування поняття дослідницького університету в зарубіжних країнах. Також здійснено правовий аналіз поняття «дослідницький університет» у законодавстві України та визначено роль прав інтелектуальної власності в його діяльності.

Research universities all around the world are the main sources of new knowledge and technology. The legally agreed independency in intellectual property rights realization of the universities results in effective commercialization of their intellectual results. The thesis deals with research university history of development and legal analysis of this category in the legislation of Ukraine, in accordance with its intellectual property rights.
Ukraine has passed the Law about higher education in September 2014. The Law firstly concluded the legal research university definition and key criteria for receiving this title. The main feature of the Law is an increased autonomy of higher educational settings to own intellectual resul&ts of their activity and to exploit it for father research activities,
including knowledge transfer, technology transfer, collaborative research etc. The thesis summarizes a list of general rights and rights for use and exploitation of intellectual &property of research university on the basis of Ukrainian legislation. On the one hand, rights for objects of intellectual property and rights to exploit them, nevertheless they were created on the university financial support or on the governmental;& rights of the university to found innovative legal bodies and to form their statute capital from the material intellectual property rights; rights to participate in collaborative research and to exploit their intellectual property rights for the pur&pose. On the other hand, the Law gives rights that influence on creation, use and exploitation of intellectual property, such as: additional governmental financial support; provision of financial and economic activity; provision of additional service&s and use of the income. As a result, the article outlines relevant criteria of research university in the world and legal definition and main principles according to Ukrainian legislation. Also it presents analysis of research university rights in t&he field of creation, use and exploitation of intellectual property rights.
