In this article on the basis of applying various classification approaches (in particular, by criteria: of the subject, directly carries out the said measures; of necessity of punishing these measures by the court or the relevant authorized bodies; of the content of measures aimed at prevention of bankruptcy (insolvency; of the legal position of the debtor, that is caused by its branch affiliation and other) a comprehensive classification of measures bankruptcy (insolvency) prevention has been devised and adduced. In this article multilevel systems of measures of bankruptcy (insolvency) prevention applicable both prior to and after the initiation of bankruptcy (insolvency) proceedings have been elaborated. The system of measures to prevent bankruptcy (insolvency) contains the following structural elements: 1) measures applicable after the initiation of bankruptcy (insolvency) proceedings in court procedures; 2) measures applicable prior to the initiation of bankruptcy (insolvency) proceedings; 3) measures applicable prior to the initiation of bankruptcy (insolvency) proceedings, the application of which requires confirmation by the bodies, endowed with organizational and economic powers; 4) measures of bankruptcy (insolvency) prevention that appl&y outside of: the court bankruptcy (insolvency) procedures, sanation undertaken prior to initiation of proceedings in the case of bankruptcy (insolvency) and other pre-trial procedures Doctrinal definitions of measures to prevent bankruptcy (insolven&cy) have been proposed. The importance of the classification and systematization of measures to prevent bankruptcy (Insolvency) is caused by the following reasons: scientific, educational, reasons related to the necessity of realization of practical &purposes, lack of attention to national scientists to the specified problems and other factors. The author sets out theoretical conclusions and practical recommendations aiming to improve legal regulation of plan of debtor"s sanation and measures of &recovering the solvency of debtor.
У цій статті на основі використання різноманітних класифікаційних підстав наведено розгорнуту класифікацію заходів запобігання банкрутству (неспроможності), розроблено багаторівневу систему таких заходів, що можуть& застосовуватися як до порушення провадження у справі про банкрутство (неспроможність) так і після такого порушення, запропоновано доктринальне визначення зазначених заходів.
В этой статье на основании использования разнообразных классификационных о&снований представлена развернутая классификация мер предупреждения банкротства (несостоятельности), разработана многоуровневая система мер предупреждения банкротства (несостоятельности), которые могут применяться как до возбуждения производства по де&лу о банкротстве (несостоятельности), так и после его возбуждения, предложено доктринальное определение названых мер.
