У статті досліджено зміст природного права людини на житло в конституціях держав світу, їх природноправову доктрину. Проаналізовано вчення про права людини на житло, їх позитивістське закріплення в різних конституціях. Установлено, що завдяки конституційному закріпленню право на житло віднесено до основних прав людини. Зроблено висновок, що забезпечення права на житло є основою, яка дозволяє домогтися здійснення всіх інших прав, що належать людині.
В статье исследовано содержание естественного права человека на жилье в конституциях стран мира, их естественно-правовую доктрину. Проанали-зированы учение о правах человека на жилье, их позитивистское закрепление в ряде конституций. Установлено, что благодаря конституционному закре-плению право на жилье отнесено к основным правам человека. Сделан вывод о том, что обеспечение права на жилье является основой, позволяющей добиться осуществления всех других прав, принадлежащих человеку.
The article investigates the content of the natural human right to housing in the constitutions of the States of the world. It is established that the constitutional right to housing is included into the basic human rights. The conclusion is made that the right to housing is the foundation that allows one to pursue all o&ther rights belonging to a person.
In the modern world understanding of constitutional rights and freedoms of the individual includes the fundamental rights and freedoms, established and guaranteed by the Constitution. They ensure the full developm&ent of personality, help to satisfy their interests and needs.
The constitutional practice of the developed countries to a certain extent has weakened the controversy over the issue of human rights on the basis of the constitutional provision of fu&ndamental rights and freedoms, which exclude the oppression and violence of the state with respect to the identity, defending its autonomy and supremacy of human rights against the state.
A historical approached is applied to the content of human r&ights to housing and its distribution in society.
Historically the concept of the human right to housing, the implementation of its norms has been developed as a result of the bourgeois revolutions, which had a universal influence on the world. Thu&s, the study of the essence of the right to housing indicates a positive trend of sustainable development and formation of human rights. In its content the right to housing contains a long history, accompanied by the struggle of the doctrines and tra&ditions of a country.
The human right to housing is based on the principles of democracy, freedom, justice, equality, recognition of the inherent worth of a person.
