У стаття досліджуються проблемні питання господарсько-правового регу-лювання відносин із обов"язкового страхування за ознаками сфера здійснення та особливий суб"єктний склад. Аналізується специфіка реалізації вказаних правовідносин у сфері господарювання. Доводиться особливість господарсько-правового закріплення відносин із обов"язкового страхування та висвітлюються основні проблеми практичної реалізації правовідносин із обов"язкового страхування у сфері господарювання.
В статье исследуются проблемныевопросы хозяйственно-правового регулирования отношений по обязательному страхованию по признакам сферы осуществления и специального субъектного состава. Анализируется специфика реализации указанных правоотношений в сфере хозяйствования. Доказывается особенность хозяйственно-правового закрепления отношений по обязательному страхованию, и освещаются основные проблемы практической реализации правоотношений по обязательному страхованию в сфере хозяйствования.
The current situation when we are in a global financial crisis the state economy and its social sphere have set the before the global insurance industry global goals and objective problems. In such circumstances, insurance play the main role in protection the property interests of policyholders a&nd third parties which could appear in the insurance relationships, and as the result, provides the mechanism that could guarantee sustainable economic growth regardless of the unfavorable economic conditions and natural disasters. Therefore, the pri&mary goal of the insurance market is to be effectively implementing into the functions. Among them: to protect the property interests of the insured; ensure the continuity of the production process and damages businesses at the expense of insurance r&eserves, without the involvement of public funds; minimize possible loss when the insured event.
It is obviously, that firstly currently defined functions are implemented in the community insurance through insurance operations in compulsory form. Me&ntioned above determines the actuality of the presented issues.
The goal of this article is to research the problem on consolidation and implementation of legal compulsory insurance in the economic sphere from the point of its special subjects, for&mulating reasonable conclusions and propose upgrades insurance legislation in this part of Ukraine.
Despite the mentioned benefits of the compulsory insurance this form is recently exposing to severe criticism on the part of practitioners as well as& from academics. In the same time the degree of dissatisfaction is almost the same for all countries where insurance has compulsory forms, regardless of their level of economic development, national traditions and other characteristics.
The aanalysi&s of the legal background, changings and termination of insurance under legislation in the sphere of insurance makes it possible to define the features of these relations in the field of management.
In our view, industry-specific insurance relation&ships with compulsory insurance in economic activity is based on the following aggravating circumstances of commercial relations: 1) the sphere of implementation; 2) specially determined participants (subjects); 3) the presence of economic obligation&s that include and combine organizational and proprietary components; 4) a significant degree of state regulation of insurance activities in the field of compulsory insurance; 5) the contents of insurance relationships in the field of management. How&ever, in this article, we pay attention to the analysis of specific economic and legal regulation of relations of compulsory insurance from the point of two from existing five elements of the system-economic and legal relationships that could have th&e implementation in compulsory insurance which determines its specificity: the sphere of economic activity and the special subjects (participants) of them.
