У статті аналізуються роль та місце перекладача у реалізації принципу мови судочинства в цивільному процесі. Наводяться підстави для залучення в процес перекладача, визначення його процесуального статусу (прав та обов’язків), правовідносини, що виникають у зв’язку з реалізацією принципу мови цивільного судочинства за допомогою діяльності перекладача в цивільному судочинстві. Автором проведено порівняльний аналіз залучення перекладача в цивільному
судочинстві деяких іноземних держав.
В статье анализируются роль и место переводчика в реализации принципа языка судопроизводства в гражданском процессе. Наводятся основания для привлечения в процесс переводчика, определения его, процессуального статуса (прав и обязанностей), правоотношения, которые возникают в связи с реализацией принципа языка гражданского судопроизводства с помощью деятельности переводчика в гражданском судопроизводстве. Автором проведен сравнительный анализ привлечения переводчика в гражданском судопроизводстве некоторых иностранных государств.
In the article a role and place of translator are analysed in realization of principle of language of rule-making in civil procedure. Grounds over are brought for bringing in the process of translator, decision of him judicial status (righ&ts and duties), legal relationships
that arise up in connection with realization of principle of language of the civil rule-making
by means of activity of translator in the civil rule-making. In addition the short comparative
analysis of bringing &in of translator is conducted in thecivil rule-making of some foreign
states. Formulated their own proposals for improvement of the entity for the purpose of legislative consolidation. Analysing judicial practice an author attention is accented on t&he competence of translator, his levels of know ledges not only of language which a person which takes part in business but also in relation to problems which arise up with complication of translating into the language of the civil legal proceeding c&ommunicates, in particular legal terminology. The questions of bringing in of translator come into question in business not after the solicitor of persons which take part in business, but on initiative of person which needs help last or on initiative& of court when he sees a requirement in the use of services of translator.
