Уніфікація правових норм та гармонізація національних законодавств як способи наближення правового регулювання в державах-членах Європейського Співтовариства
У статті подається порівняльний аналіз двох способів наближення правового регулювання в державах-членах Європейського Співтовариства: уніфікації правових норм та гармонізації національних законодавств. Порівняння проводиться за критеріями мети регулювання, джерел права, кола суб"єктів нормотворення, способу введення в дію та механізму імплементації, співвідношення з національним правом. Процес уніфікації правових норм всередині ЄС розглядається на прикладі укладених державами-членами ЄС регіональних конвенцій з питань міжнародного приватного права. Зміст гармонізації національних законодавств визначається виходячи з положень Договору про заснування Європейського Співтовариства щодо ролі та повноважень інституцій ЄС та держав-членів у наближенні національних законодавств. Також наводяться посилання на деякі рішення Суду Європейських Співтовариств, за допомогою яких пояснюється процес гармонізації з точки зору сутності права Європейського Співтовариства.
This article is dedicated to the comparative analysis of two methods of approximation of legal regulation in the Member States of the European Community: unification of legal standards and harmonization of national laws. The comparison is made under criteria of the purpose of regulation, sources o&f law, subjects of rule-making, mode of entering into force, mechanism of implementation, and correlation with national law. The process of legal standards" unification in the European Community is viewed in the light of regional conventions conclude&d by the Member States on the issues of international private law. For the purpose of determination of the matter of harmonization the provisions of the Treaty establishing the European Community are considered with regard to the role and powers of t&he European institutions and the Member States in the process of approximation of laws. Also are referenced certain cases decided by the Court of Justice of the European Communities to explain how the process of harmonization reflects the nature of t&he law of European Community.
