стемі правових гарантій. Розглянуто роль процесуальних гарантій в забезпеченні недоторканності приватного життя особи, а також проблемні питання їх реалізації з огляду на проведену науково-дослідну роботу визначних вчених.
Определены понятие и место процессуальных гарантий уголовного процесса в системе правовых гарантий. Рассмотрена роль процессуальных гарантий в обеспечении неприкосновенности частной жизни лица, а также проблемные вопросы их реализации с учетом проведенной научно-исследовательской работы выдающихся ученых.
This study concerns the definition and place of procedural safeguards
of the criminal process in the system of legal guarantees. We investigate the concept of "
procedural safeguards " that is part of " legal guarantees ". The author focuses on the role of procedural safeguards to ensure the privacy of individuals and problems of implementation in view of ongoing research work of outstanding scientists. Since the Constitution of Ukraine defines conceptual foundations of the criminal proceedings and identifies the groups of social relations, which are protected by the state. Strengthening legal protection of people, expansion and strengthening of& legal guarantees of rights and freedoms in the development of democracy and the establishment of an independent judiciary as a determinant guarantee these rights and freedoms, justice and the law - a necessary condition for the functioning of a demo&cratic state. For proper application of criminal procedural law are important decisions of the Constitutional Court of Ukraine which also provides a formal interpretation of certain rules governing criminal procedural activities. In particular, the c&onstitutional rules designed to protect privacy rights have found their explanation in the decision of the Constitutional Court of Ukraine, in the case № 1-9/2012 on January 20, 2012 by the constitutional appeal Zhashkiv District Council Cherkasy reg&ion on the official interpretation of the provisions of paragraphs, article 32, the second paragraph, third paragraph of Article 34 of the Constitution of Ukraine. The main objectives of the Criminal Procedure Code of Ukraine (hereinafter - CCP) is t&o establish a course of criminal proceedings on the basis of priority of rights and freedoms.
Procedure criminal proceedings proposed by the new Code of Ukraine, increases the level of protection of rights, freedoms and legitimate interests of the c&riminal proceedings, ensures strict compliance by public authorities in the exercise of procedural legality of procedure.
